These Terms and Conditions (“Terms”) govern your use of riselevel.com (the “Site”) and your engagement with Rise Level Marketing LLC (“Rise Level,” “we,” “us,” or “our”). By using the Site or our services, you agree to these Terms.
Our Services
Rise Level provides digital marketing services, including search engine optimization (SEO), pay-per-click advertising (PPC), content creation, link building, and related consulting. Specific deliverables, timelines, and fees for client engagements are defined in a separate proposal, agreement, or statement of work, which governs in the event of any conflict with these Terms.
No Guarantee of Results
Marketing outcomes depend on factors outside any agency’s control, including search engine algorithms, advertising platform policies, market conditions, and your own business operations. While we work toward measurable growth, we do not guarantee specific rankings, traffic levels, lead volumes, or revenue results.
Communications Consent
By submitting your contact information through the Site, or by calling or texting our business numbers, you consent to being contacted by Rise Level by phone, email, and text message regarding your inquiry and our services. Calls may be recorded for quality and record-keeping. Text messaging is governed by the SMS terms in our Privacy Policy; reply STOP to any text to opt out, HELP for assistance. Message and data rates may apply, and message frequency varies.
Payments and Refunds
Fees, billing schedules, and any refund terms are set out in each client agreement or proposal. Unless otherwise stated in writing, fees for services already performed are non-refundable, and invoices are due upon the terms stated on the invoice.
Intellectual Property
All content on this Site — text, graphics, logos, and design — is the property of Rise Level Marketing LLC or its licensors and may not be copied or republished without permission. Upon full payment, deliverables created for a client are owned as set out in the applicable client agreement.
Client Responsibilities
You agree to provide accurate information, timely feedback, and any access (websites, ad accounts, analytics) reasonably required to perform the services. Delays in providing access or approvals may affect timelines and results.
Third-Party Platforms
Our services involve third-party platforms (such as Google, Meta, and others). We are not responsible for changes, suspensions, or policies of those platforms, including their effect on campaigns or accounts.
Limitation of Liability
To the fullest extent permitted by law, Rise Level’s total liability arising out of or relating to the Site or our services shall not exceed the amounts paid by you to Rise Level for the services giving rise to the claim in the three (3) months preceding the event. We are not liable for indirect, incidental, consequential, or punitive damages, or for lost profits or revenues.
Indemnification
You agree to indemnify and hold harmless Rise Level Marketing LLC from claims arising out of your breach of these Terms, your content, or your unlawful use of the Site or services.
Termination
Either party may end a service engagement as described in the applicable client agreement. We may suspend or terminate Site access for misuse.
Governing Law
These Terms are governed by the laws of the State of Wyoming, without regard to conflict-of-law principles. Any disputes shall be resolved in the state or federal courts located in Wyoming.
Changes to These Terms
We may update these Terms from time to time; the effective date above reflects the latest revision. Continued use of the Site after changes constitutes acceptance.
